Apple sues HTC or Google's Nexus One?

Earlier this month, Apple Inc, the iPhone maker has filed legal lawsuits against smartphone maker HTC Corp, alleging that the Taiwan-based company infringed on 20 Apple patents associated with its iPhone. Apple has filed lawsuits both in the U.S. International Trade Commission and the U.S. District Court in Delaware.

The Cupertino-based company said that HTC used its iPhone’s user interface, underlying architecture and hardware. The questionable patents are related to touch-screens, gesture recognition, scrolling, power management, and other technologies. Apple is asking for an injunction to stop HTC from dealing with products breaching the patents, besides payments of potential damages.

HTC, Google join the fight

Besides Windows based smartphones, HTC presently manufactures the Nexus One phone, which uses the Android 2.1 operating system and is designed and sold by Google Inc. directly to consumers. The Nexus One comes with a touch-screen, a built-in GPS, and downloadable applications.

In its official statement, HTC has denied all the allegations of Apple. However, it would provide full support to the US judicial system to protect our own innovative values and rights. HTC claims that it is focused only to innovations and is least worried about the patents acquired by other firms.  

Meanwhile, Google, which is not a party in the case, has also joined the fight and said to protect all its vendors that use its software or technology. The search giant added that it backs the Android operating system and all the partners who have helped to develop it.

Apple iPhone comes with multitouch display and various rivals stay away from this feature for most of the year, however last year; Motorola Droid and HTC Eris were launched in the market with multitouch software and Google's Android operating system. In January this year, Nexus One from HTC arrived with multitouch technology.

Apple’s stand

It is reported that the iPhone maker had started approaching the competing handset vendors and said to take legal action against those who infringed on technology related to the iPhone. However, the name and number of the companies are unknown. After that development, Apple has filed the legal complaint only against HTC, which clearly focuses on Android based HTC devices like the Nexus One, the Magic/myTouch 3G, the Dream/G1, the Hero, and the Droid Eris.

In its official announcement, Apple CEO Steve Jobs had made strong comments in context of its patent infringements. The iPhone maker has claimed that stealing patents is a highly uncompetitive behavior; however it is not uncommon.

Discussion

Meanwhile, various analysts asked Apple, why it was so late to file complaint against HTC for the patent infringement. Is Apple waiting for Google to release its Nexus One in the market or it fears from the rise in the adoption of Google’s Android platform with various mobile vendors? Hence, the development indicates that Apple wants to sue Google and its Android based devices through this patent infringement case against HTC.
